1. Acceptance of Terms

By accessing or using SwiPredict.ai ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Service. By clicking "I Agree" on first use, you confirm acceptance.

2. Description of Service

SwiPredict is a free entertainment platform where users make predictions on real-world events using virtual SP points. SwiPredict is a game of skill — outcomes are based on real-world events and user prediction accuracy, not random chance. SwiPredict is designed as a game of skill and is not intended to be a gambling product. No real money is wagered or won. Users are responsible for ensuring their use complies with the laws of their jurisdiction.

3. SP Points — Virtual Currency

SP (SwiPredict Points) are virtual gameplay points used for entertainment purposes only. SP may be earned through gameplay or acquired through optional in-app purchases. SP are a limited license to use virtual items within SwiPredict — not a purchase of property. All SP purchases are final and non-refundable, except as required by applicable law. For Apple App Store purchases, refund requests must be submitted through Apple per their refund policy. SP have no cash-out value and cannot be redeemed, sold, transferred, or exchanged for real currency, cryptocurrency, goods, or services outside the SwiPredict platform. We reserve the right to adjust SP balances in cases of technical error.

4. Age Requirements

You must be at least 13 years old to create an account. You must be 18 years old (or the age of majority in your jurisdiction) to participate in prediction gameplay, SP wagering, and Crystal Brawl tournaments. By using the Service you confirm you meet the applicable age requirement.

5. Crystal Brawl Tournaments

Crystal Brawl is a bracket-style prediction tournament where participants compete for SP prizes. By entering Crystal Brawl:

You acknowledge that SP prizes have no monetary value and cannot be redeemed for real currency
Tournament entry may require SP wagers — these are final and non-refundable
SwiPredict reserves the right to cancel or modify tournaments at any time
Crystal Brawl is a game of skill based on real-world event outcomes, not random number generation
Crystal Brawl is not a gambling product

6. AI-Generated Content

Questions on SwiPredict are generated by AI and resolved via automated APIs. We make no guarantee of accuracy. Resolutions are final. In cases of clear technical error (e.g., API malfunction or scoring bug), we may void the question and return wagered SP to affected users. We will make reasonable efforts to correct SP award errors when reported within 7 days to contact@swipredict.ai. SwiPredict is not responsible for actions taken based on AI-generated predictions or outcomes.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. Notify us immediately of any unauthorized use at contact@swipredict.ai.

8. Acceptable Use

You agree not to:

Use the service for any illegal purpose
Attempt to exploit, manipulate, or abuse game mechanics or SP systems
Use automated bots or scripts to interact with the service
Attempt to gain unauthorized access to our systems
Create multiple accounts to abuse signup bonuses or promotions

9. Account Termination

We reserve the right to suspend or permanently terminate any account that violates these Terms, engages in abuse or manipulation, or for any other reason at our sole discretion. We will make reasonable efforts to notify you via email before or at the time of termination, except in cases of fraud or abuse where immediate action is required. Upon termination for cause, all SP (including purchased SP) are forfeited without refund. We are not obligated to restore access or SP.

10. Third-Party Market Data

Market data displayed on SwiPredict may originate from third-party prediction market platforms. SwiPredict is not affiliated with, endorsed by, or partnered with these platforms unless explicitly stated. All market data is publicly available information.

11. Intellectual Property

The SwiPredict name, logo, and all related content are the property of MassPredict LLC and its licensors. "SwiPredict", "Crystal Brawl", "MassPredict", and "Raven Aⁱ" are trademarks of MassPredict LLC. You may not use our trademarks without prior written permission.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY OF ANY PREDICTION DATA, QUESTION, OR OUTCOME. ALL DATA MAY NOT BE ACCURATE OR UP-TO-DATE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIPREDICT AND MASSPREDICT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify and hold harmless SwiPredict and MassPredict LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Dispute Resolution & Arbitration

Any disputes arising out of or relating to these Terms or your use of the Service shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA), not in court. You waive any right to participate in a class action lawsuit or class-wide arbitration. Small claims court actions are exempt from this arbitration provision. Nothing in this clause prevents either party from seeking injunctive relief in court for intellectual property violations. This clause does not apply in jurisdictions where mandatory arbitration is prohibited by law.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the courts of Alameda County, California.

17. Service Discontinuation

If we discontinue the Service, we will provide 30 days notice to registered users via email.

18. Data Deletion

You may request deletion of your account and all associated data by emailing contact@swipredict.ai. We will process requests within 30 days. Your SP balance and prediction history will be permanently deleted and cannot be recovered.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Continued use after changes constitutes acceptance.

20. International Users

SwiPredict is available globally. You are responsible for ensuring your use complies with the laws of your country or region. If prediction games are restricted in your jurisdiction, do not use SwiPredict. For EEA/UK users, GDPR rights apply — see our Privacy Policy.
